2. The Services

Sandbar Studio provides tools for managing and publishing website content, including text, images, and other media. We may add, remove, or modify features at any time.

3. Acceptable Use

You agree not to use the Services to:

• Violate any applicable law or regulation
• Infringe intellectual property or other rights
• Post or transmit unlawful, harmful, threatening, abusive, harassing, defamatory, obscene, or otherwise objectionable content
• Upload malware, attempt unauthorized access, or interfere with the Services’ operation
• Collect or harvest information about other users without authorization

4. User Content and Publishing

You retain ownership of content you create, upload, or publish through the Services (“User Content”). You grant us a limited license to host, store, process, transmit, and display User Content only as necessary to provide the Services.

You are solely responsible for User Content, including ensuring it does not include sensitive, private, or confidential information you are not authorized to share.

Content you publish through Sandbar Studio may become publicly available depending on your configuration and publishing choices.

5. Intellectual Property

The Services, including software, visual interfaces, design elements, text, graphics, logos, and other content (excluding User Content), are owned by the Company or its licensors and are protected by intellectual property laws. You may not copy, modify, distribute, sell, lease, or create derivative works based on the Services unless expressly permitted in writing.

6. Third-Party Services

The Services may integrate with or link to third-party services (for example, hosting, storage, authentication, analytics, or content delivery). We are not responsible for third-party services and your use of them may be subject to their terms and policies.

7. Fees and Payment

If you subscribe to a paid plan, you agree to pay the fees presented at purchase, including any applicable taxes. Unless otherwise stated, fees are non-refundable.

8. Suspension and Termination

We may suspend or terminate your access to the Services at any time if we reasonably believe you have violated these Terms, pose a security risk, or create legal exposure for the Company. You may stop using the Services at any time.

9. Disclaimers

The Services are provided on an “AS IS” and “AS AVAILABLE” basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Services will be uninterrupted, error-free, or secure.

To the fullest extent permitted by law, the Company will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, or goodwill, arising out of or related to your use of (or inability to use) the Services, even if we have been advised of the possibility of such damages.

You agree to indemnify and hold harmless the Company and its owners, employees, contractors, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your use of the Services, your User Content, or your violation of these Terms.

These Terms are governed by the laws of the State of South Carolina, without regard to conflict-of-law principles.
